The new Practice Direction came into force on 1st October 2010 and is designed to encourage and assist the parties to reach agreement in relation to the disclosure of Electronic Documents in a proportionate and cost-effective manner.

 

It is recommended that all parties discuss the issues surrounding electronic disclosure at the earliest opportunity. This includes involving technical experts and imposing a Litigation Hold.
